Updated 21 October 2026. We re-read the e-filing portal's non-resident FAQ, the RBI's account FAQ and Master Direction page, and the bank guidance on the day. The guide that ranks today predates the 2025 Act and fixes RNOR at two years. This one uses the new section numbers, explains why RNOR length varies, and covers the home: buying before you return, the loan, and the order in which to change your accounts.
How long does RNOR status last?
There is no fixed term. RNOR is tested every tax year, and it ends when you fail both tests: you have been resident in at least two of the last ten years, and you have spent 730 days or more in India in the last seven. For someone who spent little time in India while in the Gulf, that often means two or three tax years.
ICICI Bank's worked example: a person returning on 1 August 2022 is RNOR for 2022-23, 2023-24 and 2024-25, because their seven-year stay is still under 730 days, and becomes ordinarily resident in 2025-26 (ICICI Bank NRI Edge, position as of 31 March 2024). Count your own days from your passport stamps before relying on any rule of thumb.
- Resident test, unchanged: 182 days or more in India in the tax year, or 60 days plus 365 days in the previous four years (e-filing portal FAQ).
- NOR test, unchanged: non-resident in 9 of 10 preceding years, or 729 days or less in India in the preceding 7 years; now section 6(13) (e-filing portal FAQ).
- Visitors with Indian income above ₹15 lakh: the 60-day test is read as 120 days (e-filing portal FAQ).
Is foreign income taxable in India during RNOR?
In general, foreign income is not taxed in India while you are RNOR, as ICICI's guide explains; income earned or received in India is. That window is useful for closing out Gulf bank accounts and end-of-service benefits in an orderly way. Your own position depends on the facts, so take advice from a CA on any large receipt.
The Gulf trap: deemed residency before you even return
GCC countries do not tax salary income. Under the deemed-residency rule, an Indian citizen whose Indian income, excluding foreign-source income, exceeds ₹15 lakh, and who is not liable to tax in any other country, is treated as resident regardless of days in India. From 1 April 2026 this is section 6(7) of the 2025 Act (e-filing portal FAQ). If rent from flats in India plus NRO interest is approaching ₹15 lakh while you are still in Dubai or Doha, check your status with a CA before adding another property.
What happens to my NRE account when I return to India?
- NRE: designate it as a resident account, or move the funds to an RFC account at your option, 'immediately upon the return' for employment or on change of residential status (RBI FAQ, 16 January 2025).
- NRO: redesignated as a resident account on return (RBI FAQ; RBI Master Direction page).
- Tax: NRE interest is exempt only while you meet the non-resident conditions under FEMA. The exemption is now in Schedule IV of the 2025 Act (e-filing portal FAQ). Once you are resident, interest on the redesignated account is taxable.

Can I keep my FCNR deposit after returning?
Yes, to maturity. RBI allows FCNR(B) deposits to continue till maturity at the contracted rate if you wish; on maturity the bank converts them to a resident rupee deposit or, if you are eligible, an RFC account, at your option (RBI FAQ, 16 January 2025). ICICI notes that an RFC account has no repatriation limit (ICICI Bank NRI Edge).
Should I buy a house before or after moving back to India?
For many Gulf families, buying a year or so before the return date is simpler. Three reasons:
- Loan documents are easy: SBI accepts Gulf salary slips and bank statements and does not ask NRIs in Middle East countries for an Indian tax return (SBI Home Loans).
- You can pay from NRE savings built up in the Gulf, keeping a clean trail.
- A ready-to-move home fits a fixed school or job date; an under-construction one may slip. Our comparison: Ready-to-Move Luxury Homes in Bangalore, Gurgaon and Chennai (2026): No GST, No Waiting.
Will my NRI home loan change when I become resident?
Tell your lender. HDFC says that on return 'the lender may reassess your loan eligibility and repayment capacity' and may revise the repayment schedule, and notes that a resident has 'unfettered freedom to acquire property in India' (HDFC Bank). Practical order: set up the EMI mandate on the account that will become your resident account before you redesignate the NRE and NRO accounts, so no EMI bounces in the changeover. Eligibility check: Home Loan Eligibility Calculator; loan options: Nri Home Loan.
One more change once resident: agricultural land, which is restricted for NRIs, becomes available as an investment (ICICI Bank NRI Edge). Under FEMA, overseas assets acquired while you were an NRI can be kept after you become resident (same source).
A simple return timeline
- 12–18 months before: shortlist and buy, ideally ready-to-move; take the NRI loan while your Gulf salary documents are current.
- 6 months before: count your India days for the last seven years to estimate your RNOR years.
- Month of return: set up EMI mandates, then redesignate NRE and NRO accounts; decide whether FCNR(B) deposits run to maturity.
- First year back: file as RNOR if you qualify, and take advice on any foreign income or Gulf end-of-service payment.
