Flat owners in Tamil Nadu usually do not get a separate patta. The land under an apartment building stays under one patta for the whole survey number, and each buyer owns the flat plus an undivided share of that land (UDS), conveyed in the registered sale deed. Your title is the sale deed; the patta confirms the land the building stands on.
Updated 12 October 2026. This guide is flat-specific: joint versus individual patta, what UDS is and how to check it, the composite-value registration in force since December 2023, the Apartment Ownership Rules of 2024, and the online patta and EC checks. Is patta required for flat registration in Chennai?
Not an individual one. Ownership of a flat is established by the registered sale deed and the UDS it conveys; industry guides for Tamil Nadu buyers note that an individual patta is not a mandatory document for an apartment owner. What you must see before you buy is the patta for the whole land parcel, or the Town Survey Land Register (TSLR) extract in surveyed city areas, in the name of the landowner or the developer selling to you, for the full extent the project stands on.
After sale, practice varies. In many projects the patta for the parent survey number stays in the landowner's or developer's name, with the UDS sold to buyers. In others the flat owners' names are added, which is what people mean by a joint patta for flats. Either way, the land is not split flat by flat, so there is no individual patta for flats in the sense a plot owner has one. Ask your lawyer how the record will reflect apartment owners in your project.
What is UDS (undivided share of land)?
UDS is your proportionate ownership of the land under the building. It is undivided because no particular patch of ground is yours; you hold a fraction of the whole plot, in common with every other owner. The UDS cannot be sold apart from the flat, and it passes with the flat on every sale or inheritance.
It matters for three reasons. Land is the part of a flat that tends to hold value while the building ages. It decides your share if the building is ever redeveloped. And it decides your share of any compensation if the land is acquired.
UDS meaning in Tamil: Tamil-language explainers render it with words meaning undivided share of land. We could not confirm one standard Tamil term used in every Tamil Nadu deed, so ask your lawyer to point out the UDS clause in your sale deed, which is the one that counts. Two Tamil terms you will meet are certain: patta (பட்டா) and chitta (சிட்டா); the EC is often called the vilangam certificate.
How UDS is calculated in apartments
The Tamil Nadu Apartment Ownership Act, 2022, notified with effect from 6 March 2024, sets the rule: each owner's undivided share in the project land and common areas is in proportion to the carpet area of that apartment, relative to the total carpet area of the project. The Tamil Nadu Apartment Ownership Rules, 2024, issued on 24 September 2024, prescribe how promoters comply (JSA Law and Mondaq summaries). Older projects may have computed UDS on super built-up area, so read your own deed.
A worked example: a project on one acre (43,560 sq ft) with 1,00,000 sq ft of total carpet area. A flat with 1,000 sq ft of carpet area holds 1% of the land, about 436 sq ft of UDS. A tall tower on the same acre gives every flat a smaller UDS than a low-rise building does.
How to check the UDS before you buy
- Read the UDS figure in the draft sale deed's schedule, in sq ft, and the total land extent of the project.
- Ask the developer for the UDS statement for all units. The shares should add up to the total land; your lawyer can check this against the patta or TSLR extent.
- Match the survey numbers in the deed with the patta or TSLR extract on eservices.tn.gov.in and the approved plan.
- Search the EC for the project's survey number on tnreginet.gov.in. Earlier UDS sales to other buyers in the project will appear there, as will any mortgage on the land.
- Compare the land extent in the RERA registration on rera.tn.gov.in with the brochure.
Composite value: how flats are registered in Tamil Nadu now
From 1 December 2023, Tamil Nadu stopped registering a new flat as two documents, a sale deed for the UDS and a separate construction agreement. A first sale of a flat, villa or row house is now registered by one sale deed on a composite value covering both land share and building, with the value set through a valuation committee (JSA Law and Fox Mandal, December 2023).
The duty is charged in slabs on that composite value: 4% stamp and transfer duty up to ₹50 lakh, 5% from ₹50 lakh to ₹3 crore and 7% above ₹3 crore, plus 2% registration in each case. A resale flat pays 7% plus 2%. In December 2025 the state allowed duty already paid on construction agreements registered on or before 30 November 2023 to be set off against the composite deed: Stamp Duty, Guideline Values and Approvals: What CREDAI Tamil Nadu and Chennai Leaders Say in 2026. How to apply for patta online in Tamil Nadu
Patta transfer, or mutation, is filed on the TamilNilam citizen portal (tamilnilam.tn.gov.in/citizen), reached from eservices.tn.gov.in, or at a Common Service Centre. You register, choose transfer with or without subdivision, enter the survey number and the registered deed, upload the deed and your ID and address proof, and pay the processing fee. The full steps and fees: Patta Chitta Online: Check, Transfer, Fees, TSLR, DTCP & CMDA (Chennai 2026)
Tamil Nadu also runs automated patta transfer for registrations that do not involve subdivision; DT Next reported on 4 July 2026 that a June 2026 order extended it to deeds signed jointly by a landholder's family and to power-of-attorney sales. For a flat, the land is not subdivided and the patta is usually for the whole parcel, so check after registration whether any change applies to your project, and ask the association how owners are recorded.
EC for a flat: what to check
The encumbrance certificate (EC) lists registered transactions on a property, such as sales and mortgages. View it free online on tnreginet.gov.in by survey number and the Sub-Registrar office. For a new flat, search the project's survey numbers to confirm the land is free of undisclosed charges. For a resale flat, the EC should show the chain from the first UDS sale to the current seller. Ask your lawyer how far back to search; 30 years is a commonly used period. More: The Encumbrance Certificate: Why It Protects Your Purchase
