Updated 21 October 2026. We confirmed the rate decision on the RBI's own press release, the repatriation limits in the RBI's FAQ and Master Direction No. 13, and the TDS change in the CBDT gazette notification. The guides that rank for this search are developer pages without dollar prices, luxury addresses or this month's changes. This note adds them, with a dollar table for our ready-to-move central listings. It is general information, not personalised financial advice.

Can an NRI buy a luxury flat in Chennai without RBI approval?

Yes. Under the Non-Debt Instruments Rules, 2019, NRIs and OCIs may buy immovable property other than agricultural land, farmhouse or plantation from residents, NRIs or OCIs. Payment must come through banking channels into India or from NRE, FCNR(B) or NRO accounts; traveller's cheques and foreign currency notes are not allowed (RBI FAQ on purchase of immovable property, updated 6 April 2023). An NRI can also buy from, and sell to, another NRI.

Foreign citizens who are not OCIs and are resident outside India are a different case; take advice before committing.

What the rupee level means in dollars

On 21 October 2026 the rupee traded at about ₹94.74 per US dollar (Trading Economics). The RBI announced measures for the foreign exchange market on 10 October 2026, including curbs on rebooking cancelled currency derivative contracts (RBI, 10 October 2026). We do not forecast the rupee. The table below uses ₹95 per dollar, rounded, and our listings' starting prices.

  • ₹5 crore · about US$526,000.
  • ₹10 crore · about US$1.05 million · buys about 4,290 sq ft in Chennai (CRE Matrix, 6 May 2026).
  • Amara Avika, Poes Garden · from ₹23 crore · about US$2.42 million · ready to move in.
  • Chaitanya Gayatri, Alwarpet · from ₹10.4 crore · about US$1.09 million · under construction.
  • Vijay Shanthi The Art, Nungambakkam · from ₹8.24 crore · about US$867,000 · ready to move in.
  • Olympia The Park Residences, Kotturpuram · from ₹6.36 crore · about US$669,000 · ready to move in.

Does the RBI rate hike affect NRI buyers?

The Monetary Policy Committee voted unanimously on 7 October 2026 to raise the repo rate by 25 basis points to 5.50%. The standing deposit facility rate is now 5.25% and the marginal standing facility rate and Bank Rate 5.75%; the stance changed to calibrated tightening (RBI, 7 October 2026).

For a buyer paying from NRE or FCNR(B) savings, there is no loan, so the policy rate does not change the price paid. For a buyer using an Indian home loan, ask the lender when the loan's benchmark resets and what the new rate will be.

Do I need a TAN to buy property from an NRI in 2026?

Many trophy resale homes in Chennai are owned by NRIs, so this matters. When a resident buys from a non-resident, tax must be deducted under section 393(2) of the Income-tax Act, 2025. From 1 October 2026, CBDT Notification 121/2026 (G.S.R. 830(E), dated 22 September 2026) brings this deduction, where the buyer is a resident individual or HUF, into Form 141, with a new Schedule E for the property, buyer and non-resident seller details (CBDT, 22 September 2026).

Tax practitioners read this as removing the need for such buyers to obtain a separate TAN; companies, firms and LLPs still follow the TAN route (TDSMAN, updated 3 October 2026). The rate of deduction is unchanged. Ask your chartered accountant to compute it, including any lower-deduction certificate the seller holds.

How much property sale money can an NRI repatriate?

  • From foreign-currency funds: sale proceeds can be repatriated up to the amount paid in foreign exchange through banking channels or from NRE or FCNR(B) accounts; for residential property this is limited to not more than two properties (RBI FAQ, updated 6 April 2023).
  • From NRO funds and other sale proceeds: under RBI Master Direction No. 13 (Remittance of Assets), paragraph 3.2, banks may allow NRIs and PIOs to remit up to US$1 million per financial year out of NRO balances, sale proceeds of assets or inherited assets, on documentary evidence (RBI Master Direction No. 13/2015-16, updated 29 June 2026).
  • Keep the purchase payment trail: bank statements, foreign inward remittance certificates and the registered deed. The bank will ask for them at sale.

Can NRIs buy agricultural land or farmhouses on ECR?

No. NRIs and OCIs may not buy agricultural land, farmhouses or plantation property (RBI FAQ, updated 6 April 2023). On ECR, check that a plot is converted and approved for residential use, and read our CRZ guide for the coastal rules: CRZ Zone Chennai 2026: ECR Sea-Facing Homes, Rules and Checks.

Documents and structure for an NRI purchase

  • PAN, passport and visa or OCI card, overseas address proof.
  • NRE, FCNR(B) or NRO account for payments, and the payment trail from abroad.
  • A registered power of attorney, executed abroad and attested as required, if you will not be present at registration.
  • Title documents, approvals and TNRERA registration for new projects; completion or occupancy certificate for ready homes.
  • Ownership structure: individual, joint or through a family arrangement. Take advice on succession and tax before registering; see Should You Hold Property in an HUF, Trust or Company?.

Selling later: what to plan for now

An exit is easier when it is planned at entry. When an NRI sells, the buyer must deduct tax under section 393(2) of the Income-tax Act, 2025, and from 1 October 2026 a resident individual or HUF buyer reports it through Form 141 (CBDT Notification 121/2026). A seller who expects the tax actually due to be lower than the deduction can ask the tax department for a lower-deduction certificate before the sale; your chartered accountant can advise on timing.

Repatriation then depends on how the purchase was funded, as set out above. Buyers who fund from NRE or FCNR(B) accounts and keep the remittance records have the simplest path back. Buyers who fund from NRO balances will usually repatriate within the US$1 million per financial year route under Master Direction No. 13. Resale depth matters as much as the rules: in Chennai's ₹10 crore-plus bracket, only 58 homes sold in all of FY26 (CRE Matrix, 6 May 2026), so expect a sale at this level to take time.
