When you buy a new flat from a developer in Gurugram, the conveyance deed is the registered sale deed that transfers legal title to you. In urban Haryana it costs 7% stamp duty for a man, 5% for a woman and 6% for joint owners, plus a registration fee capped at ₹50,000. Under the RERA Act, unless local law says otherwise, the developer must execute it within three months of the occupation certificate.
Updated 13 October 2026. The top results for this search are mostly sample deeds uploaded to the Haryana RERA portal, with almost no plain explanation. We read Haryana's current stamp duty and fee schedule, the RERA provisions on conveyance, and a reported 1 October 2026 Haryana RERA order on delayed conveyance.
What is a conveyance deed in Haryana?
A conveyance deed is the document by which ownership of immovable property passes from one person to another. For a new flat, the developer is the seller. Signing the builder-buyer agreement and getting possession does not make you the legal owner. Registering the conveyance deed does.
The deed covers your apartment together with your undivided proportionate share in the common areas. Under Section 11(4)(f) of the RERA Act, the promoter must execute a registered conveyance deed in your favour and transfer title to the common areas to the residents' association or competent authority.
In everyday Gurugram use, “conveyance deed”, “sale deed” and “transfer deed” often mean the same document. The difference is usually who is selling: a developer handing over a new flat, an HSVP allottee getting title to a plot, or a resale between two owners.
What are the conveyance deed charges in Haryana?
Stamp duty is charged on the higher of the price in the deed and the collector (circle) rate for the property. As of May 2026, Godrej Capital listed these rates:
- Within municipal limits: 7% for men, 5% for women, 6% for joint ownership
- Outside municipal limits: 5% for men, 3% for women, 4% for joint ownership
- Registration fee: on a sliding scale, from ₹100 for deeds up to ₹50,000 to ₹50,000 for deeds above ₹90 lakh
- Payment: stamp duty is paid online through Haryana's e-GRAS portal (egrashry.nic.in), which generates the e-stamp
Worked example for a ₹1.5 crore flat in Gurugram (our arithmetic): stamp duty is ₹10.5 lakh for a male buyer, ₹7.5 lakh for a female buyer or ₹9 lakh for joint owners, plus a ₹50,000 registration fee. If the circle rate for your sector is higher than your price, duty is charged on the circle rate. Sector-wise rates are at Gurgaon circle rates, and the calculator is at Gurgaon stamp duty calculator.
Developers usually add their own administrative or documentation charge for preparing the deed. This charge is set by the builder-buyer agreement, not by the state, so ask for it in writing with the final statement of account.
Who pays the stamp duty on a conveyance deed?
The buyer. Builder-buyer agreements in Haryana almost always put stamp duty, registration and incidental charges on the allottee. Developers usually demand these with the offer of possession. In Haryana RERA hearings, developers have argued that a deed cannot be executed until the allottee pays these charges and clears other dues.
In practice: pay the stamp duty demand once the occupation certificate is issued and the final account is settled. Keep proof of payment. If you then follow up in writing, a delay is clearly the developer's responsibility and not a payment dispute.
How long does a builder have to execute the conveyance deed?
Section 17 of the RERA Act requires the promoter to execute a registered conveyance deed in the allottee's favour. Where local law sets no deadline, this must happen within three months of the occupation certificate. The same section covers the transfer of common areas to the association.
The occupation certificate starts the clock, so check its date. How to read an OC and a completion certificate in Haryana is covered at Occupation and Completion Certificates in Haryana: What to Check Before You Take Possession.
Can I sell a flat before the conveyance deed is executed?
On 1 October 2026, PropNewsTime reported a Haryana RERA order on exactly this question. A buyer had paid about ₹27 lakh in full for a commercial shop in Sector 37C, Gurugram, and taken possession. The developer did not execute the conveyance deed, and then refused to execute it in favour of the people the buyer wanted to sell to.
According to that report, the Adjudicating Officer held that a fully paid owner's right to transfer cannot be blocked by the developer's own delay. The officer ordered interest at 11% a year on ₹27.05 lakh from May 2020 to January 2023, ₹1 lakh as compensation and ₹50,000 towards litigation costs. The order called the right to sell an essential right of ownership. That principle helps any fully paid buyer who has possession but no registered deed.
Before conveyance, a resale works by the developer endorsing the transfer in its records. The new buyer then gets the conveyance deed directly. If you are buying such a flat, ask for the endorsement letter, the developer's no-dues certificate, and confirmation that the deed will be executed in your name.
What should I do if the builder delays the conveyance deed?
- Check that the occupation certificate has been issued and note its date. The three-month period runs from then.
- Pay the stamp duty and registration demand, or ask in writing for the demand if none has been raised
- Send a written request, by email and registered post, asking for a date for execution. Attach your payment proofs.
- If nothing happens, file a complaint with Haryana RERA asking for execution of the deed. Claims for interest and compensation go to the Adjudicating Officer. The process is at How to File a Haryana RERA Complaint in Gurugram: Process, Fee and Documents.
- Keep paying maintenance and property tax in the meantime, so that no dues can be raised against you
How is a conveyance deed registered in Haryana?
Registration in Haryana has been paperless since 1 November 2025. The deed is drafted and uploaded online, stamp duty is paid through e-GRAS, an appointment is booked, and both parties visit the sub-registrar once for biometric verification and execution. The full process, including the PAN and TDS checks that apply to deals of ₹50 lakh and above, is at Property Registration Gurgaon 2026: PAN Check, Process, Charges.
HSVP plots follow the same logic. HSVP executes the conveyance deed only after 100% of the price and dues are paid, and the allottee pays the stamp duty and registration. Even after conveyance, HSVP requires the Estate Officer's written permission to transfer the plot. More detail is at HSVP E-Auction 2026: How to Buy a Plot in Gurgaon.
Our view
Do not treat possession as the finish line. A registered conveyance deed is what lets you sell cleanly, take a loan against the flat and get mutation in your name. Budget 5–7% stamp duty and up to ₹50,000 registration from the start, ask for the deed date in writing once the OC is issued, and use Haryana RERA if the three-month period passes.
