Property registration in Gurgaon is now paperless. You upload the deed online, pay stamp duty of 5–7% through e-GRAS, book a slot, and make one visit to the sub-registrar for biometric verification. Since October 2026 there is a new step worth adding: check that both parties' PANs are correctly recorded on the deed and in the tax department's records. An income tax survey has found that thousands of Gurugram registrations were reported with a wrong or fictitious PAN.
Updated 13 October 2026. We read reports of the Badshahpur survey, the Income Tax e-filing portal's guide to the new Form 141, Haryana's paperless registration rollout, and the top-ranking registration guides. None of those guides mention Form 141 or the PAN-matching risk.
What did the Badshahpur PAN survey find?
The Hindustan Times reported on 9 October 2026 that the Income Tax Department's Directorate of Intelligence and Criminal Investigation surveyed Badshahpur tehsil in Gurugram. It found more than 35,000 property transactions, worth over ₹55,000 crore, that were either not reported to the department or reported with incorrect PANs. The department said the ₹55,000 crore is the total value of the affected deals and does not by itself indicate tax evasion.
PropNewsTime reported (12 October 2026) that nearly 25,000 properties in the Badshahpur area were registered under a single fictitious PAN over two years. Officials are examining whether the wrong PANs were clerical errors or deliberate concealment.
The reports also describe slipping compliance: only about 45 of Haryana's roughly 140 tehsildars had filed their statements of financial transactions, against more than 120 the year before. Those statements are how registrars report high-value property deals to the tax department.
Why does a wrong PAN on my deed matter?
Registrars report property deals above a threshold to the tax department, which matches them against the buyer's and seller's PANs. If the PAN is wrong, your purchase may not match your income tax records. That can lead to queries later about the source of funds, a missing record of your cost of acquisition when you sell, or confusion over who owns the property.
Under the Income-tax Rules, 2026, the threshold for mandatory PAN quoting in property deals rose from ₹10 lakh to ₹20 lakh, and the reporting threshold from ₹30 lakh to ₹45 lakh (Outlook Money, May 2026). For most Gurugram homes, both buyer and seller must quote a valid PAN.
- Before execution: check every PAN on the draft deed against the physical cards of all buyers and sellers
- Make sure the PAN is active and linked with Aadhaar. An inoperative PAN can raise the TDS rate and block online forms.
- After registration: check your Annual Information Statement on the income tax portal over the following months for the property transaction
- If it is missing or wrong, raise it with the sub-registrar's office and give feedback on the AIS. Keep the registered deed and payment proofs.
What is the property registration process in Gurgaon?
Haryana made paperless deed registration mandatory in all districts, including Gurugram, from 1 November 2025. The Realty Today and The Tribune describe the steps:
- Check the circle rate for your sector at Gurgaon circle rates, because duty is charged on the higher of the deal value and the circle rate
- Register on the state's online registration portal using OTP verification, fill in the deed form, and upload the deed and supporting documents (title chain, ID, PAN, photographs, NOCs where needed)
- Pay stamp duty and the registration fee online through e-GRAS (egrashry.nic.in), which generates the e-stamp
- The deed is checked in three stages: two registration clerks for documents and compliance, then the sub-registrar
- Book an appointment and visit the sub-registrar's office once, with witnesses, for biometric verification and execution
- Track the status through SMS alerts. Then apply for mutation in the land records, and transfer society, electricity and property tax records into your name
In its first 21 days the paperless system recorded 10,450 registrations, The Tribune reported. Early problems with stamp duty calculation and token handling were addressed in later updates. What are the property registration charges in Gurgaon?
Godrej Capital listed the current Haryana schedule in May 2026:
- Stamp duty within municipal limits: 7% for men, 5% for women, 6% for joint owners
- Stamp duty outside municipal limits: 5% for men, 3% for women, 4% for joint owners
- Registration fee: on a sliding scale, ₹20,000 for ₹25–40 lakh, ₹25,000 for ₹40–50 lakh, rising by ₹5,000 per ₹10 lakh to a cap of ₹50,000 above ₹90 lakh
Worked example for a ₹2 crore resale flat (our arithmetic): stamp duty is ₹14 lakh for a man, ₹10 lakh for a woman or ₹12 lakh for joint owners, plus a ₹50,000 registration fee. Add lawyer and deed-writer fees, which vary. A side-by-side with Bengaluru is at Stamp Duty & Registration Charges in Bangalore vs Gurgaon (2026).
Is Form 26QB still used for TDS on property?
No, not for payments made from 1 April 2026. The Income-tax Act, 2025 replaced the 1961 Act from that date, and the old Section 194-IA is now covered under Section 393(1). The Income Tax e-filing portal says the new Form 141, a PAN-based challan-cum-statement, replaces Forms 26QB, 26QC, 26QD and 26QE. Schedule B of Form 141 is for TDS on immovable property. IANS reported the form's introduction on 14 April 2026.
- When it applies: if the property is worth ₹50 lakh or more, the buyer deducts 1% TDS, even when each co-owner's share is below ₹50 lakh
- Base: the higher of the price paid and the stamp duty value, according to tax practitioners' guides
- Higher rate: TDS can rise to 20% if the seller's PAN is inoperative
- Payments made before 1 April 2026 stay under the old Act and Form 26QB
- No TAN is needed. File Form 141 from your own e-filing login and give the seller the TDS certificate.
If you buy from a non-resident seller, different rules apply. See TDS on Property & Rent in 2026: Rules, Rates & Thresholds and talk to a chartered accountant before you pay.
Our checklist for a clean Gurgaon registration
- Check the PANs of all parties against their cards and the draft deed, and confirm each PAN is active
- Deduct TDS and file Form 141 on time, and keep the challan and certificate
- Pay duty on the higher of price and circle rate. Underpaying duty creates trouble later.
- For a new flat from a developer, the deed is the conveyance deed. See Conveyance Deed Haryana: Charges, Stamp Duty, Builder Delay
- Check your AIS after registration and apply for mutation promptly
