In Bangalore, 'gated community' is a marketing term, not a legal category. A gated apartment complex is lawful: the land, internal driveways and amenities belong to the flat owners together. A plotted or villa layout is different: the Karnataka High Court has said its roads, once handed over to the civic body, cannot be closed to the public.

Updated 12 October 2026. Below are the approvals and records to check, how the owners' association works, and gated projects by budget from Property Point listings (developer information, indicative, October 2026).

What counts as a gated community flat?

Buyers use the phrase for any project with a boundary wall, controlled entry, security and shared amenities, from a single tower to a township of several phases. What you actually own is an apartment plus an undivided share of the land and the common areas. That share, and what is common, is set out in the sale documents and the project's RERA filing, so read both rather than the brochure.

For apartment complexes, yes: the internal roads are private common areas. For approved layouts, the position is stricter. In a case reported in November 2023, the Karnataka High Court held that there is no concept of a gated community in an approved layout and that residents cannot stop the public from using its roads. It cited a layout-approval condition that roads and public amenities are maintained by the civic authorities and open to all, and said owners keep no rights over roads once relinquished.

The practical point: if you are buying a villa or plot in a 'gated' layout, ask whether the roads and parks have been or will be handed over to the local body. If they have, the gate is a convenience, not a right. Villa options: Villa or Apartment in Bangalore: Which Is Better in 2026?

Khata types: A-khata, B-khata and e-Khata

The khata is the municipal record that links a property to its taxpayer. An A-khata is issued to compliant properties and is what banks generally expect; a B-khata is issued to properties that pay tax but fall short on compliance; e-Khata is the digital format and can carry either status. Ask the developer which khata each flat will receive on completion, and in which body's records. Maintenance and the residents' association

Under Section 11(4) of the RERA Act, the promoter must keep essential services running until the association of allottees takes over, and must enable the association to be formed. Section 17 then requires the common areas to be conveyed to that association. Until handover, the developer or its facility manager runs the estate on the maintenance you pay.

Before booking, ask for the maintenance rate per sq ft, how many months are collected in advance, the size of any corpus or sinking fund, and when handover to the association is planned. In a large township, ask too whether each phase has its own association or one federation runs the whole site.

What are the disadvantages of a gated community?

  • Running costs: clubhouses, pools and security are paid for by residents for the life of the building.
  • Water: many outer communities rely on tankers; Deccan Herald reported that numerous gated communities on Sarjapur Road do. Ask for the source in writing.
  • Distance: the largest sites are on the city's edges. Check your commute at peak hour.
  • Density and phasing: a township can stay a construction site for years as later phases are built.
