Updated 27 October 2026. We read both reports of the judgment (Writ Petition No. 3640 of 2023) and the January 2026 state order on rural OCs. We do not name the developer or the project: the point for buyers is the rule the court applied, not the parties.

What did the Karnataka High Court decide?

  • Issuing authority: the Samethanahalli Gram Panchayat issued the OCs between September 2016 and May 2017 (PropNewsTime, 15 October 2026).
  • Withdrawal: a December 2022 inspection found incomplete construction, and the panchayat withdrew the OCs on 10 January 2023 (PropNewsTime).
  • First round: in December 2023 the High Court restored the OCs, subject to completion of pending works and payment of taxes (PropNewsTime). That order was dated 11 December 2023 (LiveLaw Business, 12 October 2026).
  • Recall: villa purchasers then intervened. The court found that a May 2017 letter to BESCOM, stating that the remaining 41 villas were delayed, was relevant and had not been disclosed. It recalled its earlier order, dismissed the petition and revived the cancellation (PropNewsTime).
  • Scope: the cancellation covers 33 villas. OCs for villas outside those 33, including Villas 8 and 53, remain in force (LiveLaw Business; PropNewsTime).
  • Next step for an OC: fresh applications must be considered only after site inspection and technical verification (PropNewsTime).

Why can an OC be cancelled after it is issued?

Because an OC certifies a fact: that the building is complete and fit to occupy as approved. The court held that the panchayat had power to issue OCs under Section 64 of the Karnataka Gram Swaraj and Panchayat Raj Act, 1993, but that power does not remove the duty to verify construction and compliance first (PropNewsTime, 15 October 2026). It also noted the inspection had not adequately checked whether construction matched the sanctioned plan. In the report's words, 'an occupancy certificate is not merely a procedural document.'

Two further points matter for any buyer relying on a certificate. First, the court found that the architects' completion certificate treated the project as complete despite pending work (PropNewsTime). Second, the state's 2015 Model Bye-laws had not been adopted by this panchayat, so they did not bind it here (PropNewsTime). In other words, the paper trail behind an OC is only as good as the inspection behind it.

What deficiencies did the inspection flag?

The court asked the gram panchayat and the planning authority to examine these deviations and directed that they be rectified or regularised within the authorities' timelines (LiveLaw Business, 12 October 2026).

  • Location of the sewage treatment plant (PropNewsTime; LiveLaw Business).
  • Encroachment on a rajakaluve, the city's term for a primary stormwater drain (PropNewsTime).
  • Incomplete internal roads (PropNewsTime).
  • Inadequate maintenance of the diesel generator (PropNewsTime).

What happens to buyers when an OC is cancelled?

The reports do not spell out the effect on the occupants of the 33 villas. LiveLaw Business says claims by individual buyers for possession, refund, compensation or specific performance remain open before the appropriate forum. The court also left one question to the Karnataka Real Estate Regulatory Authority: whether the project counts as an 'ongoing project' under RERA (PropNewsTime; LiveLaw Business).

That RERA question is not academic. Under Section 3 of the RERA Act, 2016, projects that had not received a completion certificate when the Act came into force had to be registered with the regulator. If an OC is treated as never validly issued, a buyer's remedies may shift from the civil courts towards K-RERA. Only K-RERA can answer that for this project.

There is a practical side too. NewsFirst Prime reported in January 2026 that electricity companies and local bodies had been refusing power, water and drainage connections without a valid OC, following Supreme Court guidelines that tie essential services to OCs (NewsFirst Prime, 1 January 2026).

Panchayat OC vs GBA OC: is a rural OC weaker?

Not by law, but the checks behind it can vary. Many villa and plotted projects on Bengaluru's edges (Hoskote, Devanahalli, Anekal, Sarjapur's outer villages) fall under gram panchayats rather than the Greater Bengaluru Authority's city corporations. This ruling shows a panchayat OC can be withdrawn if the inspection was not done properly.

The rules have also moved. In January 2026 the Rural Development and Panchayat Raj Department exempted new houses on 30x40 ft plots in gram panchayat areas, built as ground-plus-two or stilt-plus-three, from needing an OC to get services. NewsFirst Prime reported a similar exemption for new buildings in GBA and other urban local bodies a few weeks earlier (NewsFirst Prime, 1 January 2026). The exemption is for small individual homes, not gated villa projects, so a villa buyer should still expect an OC.

How to verify an occupancy certificate before you buy

These are our general checks, not a court direction. For the difference between an OC and a completion certificate, see Occupancy Certificate vs Completion Certificate in Bengaluru: What to Demand Before You Take Possession.

  • Match the OC to your unit: the certificate or its annexure should list your villa or tower number. A project-level OC that leaves units out does not cover them.
  • Match it to the plan: compare the number of units, floors and built-up area in the OC with the sanctioned plan. A gap is a question to ask before paying.
  • Ask the issuing body directly: write to the gram panchayat or the city corporation and ask whether the OC is in force and whether any notice, withdrawal or court order exists against it.
  • Read the RERA page: check whether the project is registered with K-RERA and what completion date it shows; our step-by-step guide is here: How to Check RERA Registration in Karnataka: 7 Steps
  • Look for drainage and access issues: stormwater drains and internal roads were among the deficiencies here. Ask for the layout plan showing drains and buffer areas.
  • In a resale, put it in writing: ask the seller to state in the sale agreement that no notice or order affecting the OC has been received.

What the court asked officials to do

  • The panchayat must examine the conduct of the architects and, if needed, refer them to the Council of Architecture or another competent body (PropNewsTime).
  • The panchayat and the Principal Secretary of the Rural Development and Panchayat Raj Department must inquire into the role of the then Panchayat Development Officer and other officials, with disciplinary action if lapses are found (PropNewsTime).
  • Compliance must be reported within three months (PropNewsTime).
